Terms and Conditions
1. The highest bidder on any Lot, whether such bidder is present at the Auction Sale, or represented by the Auctioneer, will be the purchaser of this Lot. In the event of any dispute between bidders, the auctioneer shall have absolute discretion, either to determine the successful bidder, or to re-offer and re-sell the Lot in dispute. If any dispute arises after the Sale, the Auctioneer's records shall be conclusive as to the purchaser, the final bid, and in all other respects.
2. Lots are sold in full accordance with the descriptions given in the Catalogue. If the buyer finds a serious defect not mentioned in the Catalogue, the item may be returned against full credit by the Auctioneer, provident that within 14 days after the sale Hondius Auction House will have received notice in writing from the buyer in what respect the description is incorrect and within 14 days after such notification the buyer returns the same to Hondius Auction House in the same condition as at time of sale. With these exceptions all actions of the buyer for amendment of recession of the sale and/or restitution of the sale price and/or damages are excluded. Books are in octavo-size and in the original or contemporary binding, unless otherwise stated. Small defects, such as unimportant stains, library stamps, unimportant damage to bindings, etc., will not be considered justified reasons for returning purchased Lots and Lots of two or more books tot the Auctioneer. Periodicals are mostly not collated and sold with all faults. Framed prints are not examined out of their frames.
3. The Auctioneers reserve the absolute right, a. to withdraw any property at any time before its actual sale, b. to refuse any bid from any bidder, and c. to divide or to unite Lots during the course of the sale. - The Auctioneer is the sole judge as to the amount to be advanced at each succeeding bid, which is 10 percent generally. The Auctioneer is entitled to correct mistakes when advancing bids.
4. The purchaser will be considered to have bought for his own account, and can never claim to have bought any Lot for someone else.
5. No Lot may be removed during the Auction, nor can any Lot be removed unless payment of all moneys due from the Buyer has been received.
6. All Lots are sold against immediate payment of cash, debit card, credit card ( 3 % surcharge ) or cheque, with the provision that all Lots sold to purchasers not present at the Sale, and not removed from our premises within a week after conclusion of the Sale, will be billed, and sent for collection to his last known address, and that in such a case the purchaser is held to pay immediately on receipt of the invoice. Payment may be made by banker's draft to our account:
Shipment of purchased goods is at buyer's risk and expense.
7. If the purchaser fails to settle his account, later than two weeks after receipt of the invoice, his account will be charged with interest at a rate not exceeding 1,5 per cent per month on the `total amount due' to the extent it remains unpaid for more than 5 working days after the day of auction. Any fees incurred for collection of our bills are for buyer's account.
8. There is a commission rate of 25 per cent due on the hammer price of each Lot (incl. all taxes).
9. No special notification will be sent in case of unsuccessful bidding.
10. Netherlands Law shall govern the legal relations between the participants in the auction amongst themselves and between.
